OPS Medical Terms and Conditions of Sale

Acceptance

All orders are subject to acceptance OPS Medical, a trade name of OurPlanet Solutions, LLC, Pasadena, Maryland ("Seller") and all payments must be made payable to Seller or Seller's authorized entities. No other person, firm or organization shall have any authority, expressed or implied, to enter into any agreement to the contrary. By submitting an order to Seller for delivery the Purchaser set forth on the order form hereby agrees to these Terms and Conditions, which constitute the entire agreement of the parties. No term or condition of the Purchaser’s order additional to, or different from these terms and conditions and no waiver, alteration, or modification of any of the provisions hereof shall become part of these Terms and Conditions or be binding unless in writing and signed by an officer of the Seller at its principal offices in Pasadena, Maryland. All claims of damages, errors or shortages must be reported by the buyer within ten (10) business days after the goods are delivered. Failure to make such claims within the stated period shall constitute an acceptance of the goods and an admission that they fully comply with all of the terms, conditions, and specifications of order and invoice.

 

Returns

No returns will be accepted without prior authorization. Under no circumstances will merchandise in Purchaser’s possession over thirty (30) days be subject to return for credit. A fifteen percent (15%), of the sales price of purchased products, inspection, handling and re-shelving charge will be made on returns at Seller’s discretion. Products must be returned to seller prepaid. Products may not be returned which are contaminated by infectious agents, radioactive compounds or other materials constituting a health hazard to our employees. Any reconditioning charges, charges for parts and labor, charges for missing accessories, will be added to the restocking charge.

 

Price, Taxes, Terms

Quoted prices do not include federal, state, or local taxes, including without limitations sales, use or exercise taxes; OPS Medical collects sales tax only for the state of Maryland. Purchaser shall be responsible for all such taxes, and such taxes, when applicable, will appear as separate and additional items on Seller’s invoices unless Purchaser provides Seller with a proper tax-exemption certificate.  Outside the state of Maryland, the purchaser is responsible for direct payment of any sales and use tax as require by your home state.  Prices and terms are subject to change without notice.

 

Terms of Payment

Purchaser may prepay for the products they order, or open an account only with approval of credit. If, in the Seller’s judgment, the financial condition of the Purchaser at the time goods are ready for shipment does not justify the terms specified, Seller may change the terms or require full or partial payment in advance. Past due amounts are subject to 1.5% per month service charge where lawful, or otherwise the maximum charge allowed by law, and reasonable attorney fees.  For approved orders over $3,000, a 25% down payment may be required.  Final invoice with adjustments will arrive upon delivery of equipment. 

 

Deliveries

Quoted shipping dates or pricing are approximate. Seller does not assume any liability, consequential or otherwise, because of delay or failure to deliver all or part of any order for any reason. Partial shipments will be considered as separate sales and invoiced accordingly.

 

Shipping Terms and Conditions

Products are shipped F.O.B. Pasadena, Maryland or may be dropped shipped from the manufacturer of the product.  Shipping, handling and insurance (if applicable) charges will be prepaid and added to the invoice at time of order. Typical ground shipping time is 1-5 days depending on your location.  OPS Medical makes its best effort to process and ship each order in a timely fashion.  OPS cannot be held responsible for shipping delays due to weather, delivery system malfunction, or manufacturer's backorder of product. Please notify us or choose a faster shipping method at time of order if you have any special time requirements for your order. Out of country (USA) order recipients should be aware that unforeseen delays due to customs or transportation issues may arise.  Also out of country (USA) order recipients are responsible for their inbound customs fees or taxes and should be aware of these cost prior to placing your order. 

 

Security Interest

The Purchaser hereby grants to Seller a security interest in and the rights to possession of the goods upon default in payment until all payments have been made in full.

 

Governing Law

The validity, performance and construction of this agreement shall be governed by the laws of the State of Maryland. If any clause or provision hereof is invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of any other clause or provision.

 

Warranty

Products sold by seller have varying time length and conditional manufacturer’s warranty covering the product/s against defects in materials or workmanship, as stated in each product/s manufacturers User Guide. Upon notification of such defects, Seller will either repair or replace the product, with a new product or equivalent, at its sole discretion. The product must be returned to OPS Medicals Service Center in Pasadena, Maryland, transportation costs pre-paid by the purchaser.

 

Service and Repair

For select products technical service and support is available through OPS Medical, Pasadena, Maryland by dialing our toll free number (800) 430-0048. Service is available during regular business days and working hours. Repair of products (warranty and non-warranty) is performed at the Sellers facility in Maryland or as specified by the manufacturer at their facility. . Products may only be returned for repair after an RMA number has been issued. Seller reserves the right to either exchange or repair products, in part or as a whole, as deemed appropriate and more cost effective by Seller or its suppliers.

 

Billing Information – CPT Codes

Verification of acceptance and payment amounts for CPT codes and ICD’9 provided by OPS Medical to the customer  is the responsibility of the customer.  Due diligence should be performed prior to purchase.  OPS Medical makes no guarantee or warranty for the acceptance and payment amounts for any CPT codes or ICD-9 by their insurance companies. 

Purchasers of products from this site acknowledge that they are licensed medical professionals and release OPS Medical of all liability.

Purchasers of the Ageon Vitality System accept that they are purchasing a non-medical device designed for educational purposes only.

Purchasers of the Meditrac Traction Braces must be licensed medical professionals.  Please note that United States Federal law restricts this device to sale (within the United States) by or on the order of a physician only.
